Even before you enter into marriage, you may want to put in place a pre-nuptial agreement setting out what you want to happen to your assets, should the marriage end in divorce.
It may seem a negative, or unromantic, thing to consider at the time but it can save a lot of heartache and cost later. Although not binding in English law, the Court can take into account a pre-nuptial agreement when considering your financial circumstances. The existence of pre-nuptial agreements is increasing. If you have had legal advice regarding the terms of your pre-nuptial agreement it can have a bearing as to how the Court views it in the event of a dispute.
